So-called “red flag” laws are rife with the potential for destroying people’s due process rights, which is why groups like the Gun Owners of America refuse to back the measures. The thing is, they make a valid point. Unless the laws are written just right, private citizens can be disarmed on the untrustworthy word of people with grudges to settle, for example.

In New York, Governor Andrew Cuomo has figured why even bother pretending due process is even a thing.

Teachers and school administrators would be able to ask a judge to remove guns from the homes of troubled students under a first-of-its-kind proposal announced Tuesday by New York Gov. Andrew Cuomo.

The Democratic governor acknowledged his proposal will run into political opposition from Republicans, including those that control the state Senate. But he said it’s a commonsense way to prevent school shootings and get help to students at risk of harming themselves or others. He said it was a far more effective way of protecting students than arming teachers.

“This is a sensible, positive, helpful alternative,” he said. “Many times the teacher knows this an issue.”

Under the measure, teachers and school administrators would have legal standing to petition a court to remove any firearms from the homes of students considered a threat to themselves or others. New York would be the first state in the nation with such a law if the bill passes.

Teachers Unions are backing the bill, and why not? It would give them power over students’ home lives in an unprecedented way. Especially when we have cases where students engaged in lawful activities have been singled out for punishment simply because a firearm was involved. Imagine what life would be like if those same teachers could not only punish the students, but also the parents?

Meanwhile, no one is claiming that the parents are a threat. Oh no, this doesn’t involve dangerous parents at all. It’s about people who aren’t necessarily even old enough to own firearms who might be a potential threat and taking away property owned by the parent despite that parent having done nothing to warrant such an act.

Imagine, for a moment, that we were considering a different sort of law. How would Cuomo and others feel if the proposal would take away parents’ computers because their children might be cyberbullies?

Undoubtedly, many of the same people applauding this measure would be outraged over such an idea. Particularly if a Republican proposed it. If a Democrat suggested it, well…let’s just say partisanship is ugly.

The fact that Cuomo even suggested this tells you all you need to know about him as a politician and a human being. It also tells you everything you need to know about the man’s understanding of the Constitution, which is non-existent.

But remember, folks, no one is coming for your guns. Nope. Not a soul is coming for our guns. Except for the governor of New York, at least. And a former Supreme Court justice. And a sitting United States congressman.

Other than them, of course.

Also remember that if people like Cuomo get their way, no one’s rights are safe.
