Cuomo Signs New York Particularly Problematic Red Flag Bill

If you’re a parent with a child in school, have you ever gotten mad at the school over something? Have you ever had a teacher or administrator be a total jacka** to you, and you respond because you’re legitimately angry?

If so, you probably talked to your friends about what happened, and they understood. “I’d be pissed too,” they probably said.

Well, in New York, that might be enough to get your guns taken away from you thanks to Governor Andrew Cuomo.

The Red Flag Law got the green light in New York on Monday.

The law allows courts to temporarily seize firearms from people who are showing “red flags” or signs of violent behavior.

Governor Andrew Cuomo signed the bill in New York City on Monday. House Speaker Nancy Pelosi was also there. Pelosi called the law “landmark gun violence prevention legislation.”

Though other states have similar laws, New York is the first state to give teachers and school administrators the power to pursue court intervention if they believe someone poses a threat to themselves or others. A judge can then order an evaluation for the person or persons in question and remove firearms from their possession if they see fit.

Linda Beigel Schulman said this legislation would have saved her son’s life. Schulman lives on Long Island, but her son Scott lived in Florida.

Scott was one of the teachers killed in the shooting at Marjorie Stoneman Douglas High School in Parkland, Florida. last year.

Do you know what else would have saved Scott’s life? If the gunman had been arrested on any of the dozens of domestic violence complaints police responded to before the shooting.

Look, the problem here is pretty simple. Teachers aren’t mental health experts for one thing. While they do spend a lot of time with their students and might notice issues with them–in theory, at least–these are kids who aren’t legally old enough to buy a gun anyway. That means the weapons being taken will be the parents’.

Further, nothing in this says they can’t claim an angry parent represents a danger to themselves or others, meaning voicing your outrage at the academic negligence that passes for an education in far too many schools may well be enough to get you a knock on the door from police who want to take your guns away.

Think about that for a moment.

Let’s also remember the ideological predilections of most teachers in this day and age.

This move is nothing more than to give progressive power bases more authority in the world at large, especially regarding guns. Cuomo is empowering his base, giving it greater authority to take away the guns of their ideological opponents, not because it will make anyone safer. Not really.

No, it’ll be a way to punish people who dare to disagree with them, who question their authority.

So if you live in New York and you’ve got a problem with what a teacher is doing, be very, very careful. Your righteous anger could be used against you.
