Man Shoots Neighbor After Breaking Into Home

A homeowner protected himself and his fiance after an intruder was found in his kitchen, and began to advance menacingly towards them.

A man with unclear intentions spent his Saturday in the hospital after getting shot by his neighbor who believed he was an intruder.

Mike, who doesn’t want his last name used, is grateful he knows how to use a gun.

“In the situation that happened here in my house tonight, that fire arm saved my life,” he said.

Mike and his fiancé woke up at 2 a.m. on Saturday after they heard a loud bang.

“The dogs were barking. I left my bedroom to find an intruder standing in my kitchen; he was ordered to stop. He advanced forward, and that’s when I did what I had to do to protect myself and my family,” he explained.

Mike said his house was dark and groggy before he saw a silhouette coming for him. After ordering the person to stop, Mike said he fired two gun shots.

“At that point in time you are in fear for your life. You don’t know if this guy is armed; you don’t know what he is armed with; you don’t know what his intentions are; you can’t take those chances in the middle of the night,” he said.

Deputies said the man in the kitchen was 25-year-old Cody Miller—who lives across the street from Mike.

Deputies said they believe Miller was intoxicated when he allegedly kicked down Mike’s door.

Criminal defense attorney Scott Moorey said this is an open-and-shut case—a classic situation of self defense.

“Cut and dry self defense—no if’s ands or butts,” he said. The castle doctrine allows an individual who is in your own home to use deadly force if someone is in their home and they feel threatened.”

Deputies said Mike is not facing any charges. Cody Miller was hospitalized Saturday afternoon, and he is in stable condition. Charges against Miller are still unclear.
