The state of New York has never really been pro-gun, but it wasn't as anti-gun as it has become over the last handful of years. Mostly, they left much of the gun control up to New York City, and since that was pretty extensive, things were bad enough. Even before Bruen, though, that started changing, and the anti-gunners sought to inflict that stupidity on the rest of the state.
Lest we think they were done with the stupid, though, we've got another proposal that is bound to rile all of us up but good.
See, it's not enough to make it as hard as possible to exercise your right to bear arms. Not for anti-gunners up that way. Not by a long shot.
Now, they want to make it as much of a pain to actually buy a gun as they can. They want to make you wait.
Not content with all of the other onerous laws they’ve passed, many of which are currently being challenged in the courtroom, Democrats in the New York legislature have introduced a measure that would require lawful citizens to wait 10 days after passing a background check and purchasing a firearm to pick it up from the retailer.
Ostensibly a safety measure, Senate Bill 362 states: “No dealer in firearms shall deliver any firearm, and no person shall take possession of any firearm from a dealer in firearms unless ten days have elapsed from the date such dealer initiated the national instant criminal background check of the purchaser as required by 18 U.S.C. § 922 (t), after receiving a completed federal Firearms Transaction Record, Form 4473, from the purchaser; and such dealer has received notice that the purchaser has passed all background checks required by federal, state and local law.”
The National Rifle Association Institute for Legislative Action (NRA-ILA) is warning New York members about the measure, pointing out its ineffectiveness and danger to lawful citizens.
“This legislation will do nothing to improve public safety,” NRA-ILA wrote in an alert. “Rather, it arbitrarily creates an unnecessary delay for New Yorkers wanting to lawfully exercise their Second Amendment rights.”
In fact, NRA-ILA has extensive information on its website detailing the ineffectiveness of waiting periods and the fallacy of “cooling off” periods.
“There is no evidence that waiting periods reduce suicides, homicides or mass shootings,” the fact sheet states. “No studies that identify causal effects have been identified by any of the independent literature reviews conducted since 2004.
However, anti-gunners keep pushing the terrible studies that claim otherwise, and the media allows them to.
Look, the idea here may be to sell it as a "cooling off" period, but it's really about just trying to make it so bothersome to buy a gun that you just don't want to fool with it.
For die-hard Second Amendment supporters, that won't be enough, but the current normies we need to join our ranks might be put off by the waiting period and just not worry about it.
Let's understand that a right delayed is, in fact, a right denied. No one orders a cooling-off period before buying a computer, despite the fact that the same people who want this seem to think that words are violence. Why is that?
The truth of the matter is that even if a modest cooling-off period did some kind of good, 10 days is absolutely ridiculous. Since it doesn't do any good, we might as well not delay the right.
Let's understand that while I oppose all gun control, it might be a tougher sell in opposing measures that actually did some good. This one doesn't. It never would.
The best-case scenario for this would be that suicidal people would just try another method.
Meanwhile, people who desperately need protection will be denied their right to keep and bear arms, which may result in an untold number of deaths simply because good people couldn't protect themselves from the threat they know is coming.
On every level, this is just plain wrong.
