I support ICE and what they've been doing for the last couple of years, at least on the whole. Have there been mistakes? Undoubtedly. You can't have that many people running around trying to enforce immigration law while others are screaming at you and calling you everything but a decent human being and not have someone go off half-cocked or to get overly aggressive with someone. It's going to happen, and when it does, it needs to be dealt with firmly.
And in Fresno, California, an alleged case of an ICE agent behaving badly was met with an immediate response from an armed citizen.
Now, the agent is facing charges.
An off-duty 32-year-old ICE agent from Texas, who police said appeared “intoxicated and agitated,” was shot early Friday after reportedly attacking a 72-year-old Tower District man and his adult daughter outside the family’s home.
...
Fresno Police detectives on Friday concluded that the gunshot was the culmination of a woman of the Tower District neighborhood coming home to find [David] Gonzalez sleeping on their lawn. The woman alerted their father, who lives in the home with her.
The two residents attempted to wake Gonzalez up, but the federal agent, who seemed to be intoxicated at the time of the event according to a police news release, attacked both the woman and her father. Both residents sustained visible injuries after the altercation. Police said the 72-year-old man then fired a single shot at Gonzalez, striking the off-duty federal agent.
Based on what we're being told, it sounds a pretty clear-cut case. Gonzalez allegedly got up, lashed out at two innocent people, and injured them both to some extent, then got shot for his troubles on top of the assault charges he's now facing.
Being a federal agent doesn't make you immune to the repercussions of your actions. That goes double for actions you take while off-duty.
With that said, this is Fresno. It's not some small town on the Texas border where they love ICE. It's entirely possible that what's being relayed isn't true, but at this point, I'm not sure it would matter all that much. This information is coming from law enforcement. If they're covering for the residents somehow, it's unlikely there will be any evidence available in court that would exonerate the agent.
And if the two residents had physical injuries, well, that doesn't look good for Gonzalez.
They've ruled the shooting self-defense and the 72-year-old resident won't be facing any charges for allegedly defending himself from an attacker. And, based on what we know, there shouldn't be. A drunken attacker who has already caused some injuries and doesn't seem inclined to just leave the property but does seem to like the idea of potentially pummeling you to death is one of those threats you shouldn't play around with. Particularly when it's an elderly man and a woman faced with a 32-year-old federal agent who is, presumably, fairly fit.
This will be interesting to see play out in the long term, because if there are any shenanigans going on, we'll hopefully find some evidence of it. If not, well, Gonzalez will get what he deserves, which should include termination.
