As promised, the Justice Department's new rights restoration website was officially brought online this week, with 5,000 people able to start their application in the first phase of the process opening to the public. DOJ had previously invited certain individuals to initiate the process, but this week marked the first time that members of the general public have been able to seek to have their right to purchase, possess, and carry a firearm restored by the Attorney General.
The DOJ's Second Amendment rights restoration process opened this morning and has already hit its temporary limit of 5,000 applications: https://t.co/LYTDOBS6Ax https://t.co/YX0qNcSe4L

Another 500 individuals will be able to submit their applications on January 4, and at some point next year it's expected that the DOJ will allow for a much larger number of applicants. The DOJ anticipates that more than 300,000 people will apply in the first year that the portal is open, but are moving slowly at first because there hasn't been a functioning federal restoration process for more than three decades.
The January opening is specifically designed to test the department's payment system. Once the DOJ is satisfied that its application procedures are working properly, the floodgates will hopefully open.
How long they'll remain that way is another question entirely.
A federal rights restoration process has existed on paper for decades. Since the early 1990s, though, Congress has refused to direct funds to the ATF to administer that program. The DOJ is doing a workaround by running the program directly and reallocating existing departmental appropriations to cover the cost, though the agency is also asking for extra money from Congress to hire additional personnel to make sure the process is running smoothly.
This could be one area that Democrats target once they're the ones crafting budget bills in the new year.
A standalone bill defunding the program would face a likely Trump veto. Overriding that veto requires two-thirds of both chambers, and Democrats won't have the numbers.
The more realistic danger is an appropriations showdown. Democrats could insist on including a restoration-program funding restriction in a broader spending bill that the White House wants enacted. Trump could veto it, but that might mean risking a government shutdown or forcing further negotiations.
We'll have to see what the FY2027 Commerce, Justice, Science appropriations legislation and any subsequent continuing resolutions contain. Those would be the most natural vehicles for language restricting DOJ's restoration activities.
Now, there's no guarantee that Democrats will make defunding the restoration program a priority, but given their longstanding opposition to our Second Amendment rights, I wouldn't rule it out either. Democrats are all in on restoring a felon's right to vote, but they have a much different mindset when it comes to the right to keep and bear arms. They don't just want to keep prohibited persons prohibited, after all. They want to make it impossible for those of us without any criminal convictions to exercise our Second Amendment rights too.
There's a genuine need for this program, and it would be a bitter disappointment if Democrats end up targeting it. We're talking about people who may have committed a nonviolent offense decades ago, paid their debt to society, and lived law-abiding lives ever since. Under federal law, many of them are still prohibited from possessing a firearm, even if they've long since demonstrated that they're no threat to public safety.
The restoration process isn't a rubber stamp. Applicants still have to undergo a background investigation, and the Attorney General must be satisfied that they're unlikely to act in a manner dangerous to public safety and that restoring their rights would be in the public interest.
After more than three decades of inaction, thousands of Americans finally have a chance to regain a fundamental civil right. It would be a cruel, if not unusual, punishment if a Democrat-controlled Congress slammed the door shut again and kept hundreds of thousands of nonviolent offenders from having all of their rights restored once they've completed their sentence.
